Serious Breaches of Tenancy

Where a serious breach of the Tenancy Agreement or Allotment Rules has occurred, the Council reserves the right to bypass the standard enforcement stages and issue an immediate Notice of Termination.

In such cases, you will be required to vacate the plot within 28 days, and your tenancy will be formally ended.

Serious breaches include, but are not limited to:

  • Abuse, harassment, racism, intimidation or violence towards other tenants, Council officers, contractors or members of the public.

  • The commission of any illegal, criminal or immoral act on site. This includes (but is not limited to) the cultivation of illegal substances, the growing of invasive or prohibited species, the use or supply of illegal drugs, or being under the influence of drugs or alcohol while on site.

  • Sub-letting, assigning, selling or otherwise transferring any part of your allotment plot to another person.

  • Trading from the site or selling produce or goods for commercial gain.

  • Using the allotment plot for purposes other than allotment gardening, such as the storage of scrap metal, waste materials, hazardous substances or other unauthorised items.

  • Carrying out activities that may cause significant risk or harm to human health, animal welfare or the environment.

  • Tampering with, altering, damaging or misusing any communal facilities, utilities, locks, gates, fencing, water supplies or other Council property.

The Council may request information from tenants in relation to alleged breaches of the Rules. Such requests must be complied with fully and honestly. Providing false or misleading information may itself result in formal action being taken.
 

Your plot - terminated tenancies 

You will have been given a set period of time to clear the plot of all rubbish and structures and materials or crops that you wish to keep. This period is usually 28 days from the issuing of the Eviction Notice.  

After this period, the plot will be re-let to new tenants and you will no longer have a right to enter or cultivate the plot. 

If you have moved address and not received communications the termination will still stand as it is your responsibility to keep us informed of your current address. 

Please do not wait until you receive an Eviction Notice as it is too late at this point and you will have to leave your plot. 

If you have been evicted from a plot, you may not be able to go back on the waiting list for a Bolton allotment.
